Although the Law Society AGM was heavily dominated by the ABS debate this year, that meeting approved also The Solicitors (Scotland) (Drafting Wills) Practice Rules 2010 which came into force on 1st October 2010. The notes for guidance advised that the purpose of the new rules is substantially the same as the previous rules in Paragraph 8 of the schedule to the Standard of Conduct Practice Rules 2008, dealing with wills containing legacies in favour of solicitors or connected persons. The new rules are said to avoid the unnecessarily restrictive and inflexible effects of Paragraph 8. However, the new rules are considerably longer than the previous rules and appear to be written in wider terms and the text of the new rules are attached below for convenience.  Observations are invited.
